Terms of Service

1. Agreement to Terms

By accessing or using ARIS at www.alwaysberushing.com/aris ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a binding legal agreement between you and ABR Venture, owned and operated by Isaac Rushing ("ABR," "we," "us," "our").

2. Description of Service

ARIS is a Master Prompt Generator that uses AI to help users create high-quality, personalized AI prompts. The Service includes:

• A Hybrid Vetting Engine (HVE) that gathers context about your goals through a structured intake
• AI-generated Master Prompts tailored to your Identity Core (gathered during onboarding)
• Access to multiple AI providers: Google Gemini (default, server-side), and support for user-supplied Anthropic, OpenAI, and xAI API keys
• Optional account creation for session persistence and multi-device access

3. Eligibility

You must be at least 13 years old to use ARIS. By using the Service, you represent that you are at least 13 years of age. Users under 18 must have parental or guardian consent.

You represent that you have the legal authority to enter into these Terms and that your use of the Service complies with all applicable laws in your jurisdiction.

4. Accounts and Authentication

4a. Account Creation

You may use ARIS as a guest or create an account via email/password or Google OAuth. Guest sessions use your browser's localStorage for temporary storage and are not persisted to our servers.

4b. Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@alwaysberushing.com if you become aware of any unauthorized use of your account.

4c. Accurate Information

You agree to provide accurate, current, and complete information during registration and to update it as necessary.

5. User-Supplied API Keys

ARIS allows you to connect your own API keys for Anthropic (Claude), OpenAI (ChatGPT), and xAI (Grok). By providing these keys, you acknowledge:

• Your keys are stored in your browser's localStorage and are never transmitted to or stored on ABR Venture servers
• You are solely responsible for the security of API keys on your device and browser
• All usage billed to your key accounts is your sole responsibility and subject to the respective provider's terms of service
• You must comply with the acceptable use policies of Anthropic, OpenAI, and xAI when using ARIS to route requests through those providers
• ABR Venture is not liable for charges, quota overages, or policy violations incurred on your provider accounts

6. Acceptable Use

You agree NOT to use ARIS to:

• Generate, distribute, or facilitate content that is illegal, harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Violate the acceptable use policies of any AI provider accessed through the Service (Google, Anthropic, OpenAI, xAI)
• Circumvent, disable, or interfere with security features of the Service, including rate limiting, authentication, or access controls
• Scrape, harvest, or systematically extract data from the Service without written permission
• Use the Service to develop a competing product or service without written consent
• Transmit malware, viruses, or any code designed to harm systems or data
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Exceed rate limits by any means, including through automated scripts or proxies
• Use the Service for any unlawful purpose

We reserve the right to terminate access for any user who violates these provisions.

7. AI-Generated Content — Disclaimers

ARIS produces AI-generated outputs ("Master Prompts" and conversational responses). You acknowledge and agree that:

• No accuracy guarantee. AI outputs may contain errors, inaccuracies, hallucinations, or outdated information. We do not warrant the accuracy, completeness, or fitness of AI-generated content for any particular purpose.
• Not professional advice. Nothing generated by ARIS constitutes legal, financial, medical, psychological, or other professional advice. Do not rely on AI outputs in place of qualified professional consultation.
• User responsibility. You are solely responsible for how you use, share, or act on any AI-generated output from ARIS.
• Provider policies apply.Content generated via third-party AI providers is also subject to those providers' content policies and restrictions.

8. Intellectual Property

8a. Your Content and Outputs

You retain ownership of the inputs you submit to ARIS and the AI-generated outputs you receive. ABR Venture does not claim ownership of your prompts or the Master Prompts generated for you.

By submitting content, you grant ABR Venture a limited, non-exclusive, royalty-free license to process and transmit your inputs solely to provide the Service.

8b. ARIS Platform

The ARIS application, brand, system prompts, codebase, and all related intellectual property are owned by ABR Venture. You may not copy, modify, distribute, reverse-engineer, or create derivative works of the platform without written permission.

8c. Feedback

If you submit feedback, bug reports, or suggestions, you grant ABR Venture an irrevocable, royalty-free right to use such feedback without compensation or attribution to you.

9. Rate Limits and Fair Use

The free tier of ARIS is subject to the following rate limits to ensure fair access for all users:

• Anonymous (guest) users: 20 requests per hour per IP address
• Authenticated users: 60 requests per hour per account

Attempts to circumvent rate limits will result in immediate account suspension. We reserve the right to adjust these limits at any time.

10. Privacy

Your use of ARIS is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

11. Third-Party Services and Links

ARIS integrates with or routes requests to third-party services including Google Gemini, Anthropic, OpenAI, xAI, Supabase, Vercel, PostHog, and Upstash. Your use of these services through ARIS is subject to their respective terms of service and privacy policies. ABR Venture is not responsible for the conduct, policies, or practices of these third parties.

12. Disclaimers and Limitation of Liability

12a. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.

12b. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ABR VENTURE AND ISAAC RUSHING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST TWELVE MONTHS, OR (B) $10 USD.

12c. Indemnification

You agree to indemnify, defend, and hold harmless ABR Venture and Isaac Rushing from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We may also update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

We are not liable for any downtime, data loss, or damages resulting from service interruptions, including those caused by third-party providers (Vercel, Supabase, Google, etc.).

14. Termination

We may suspend or terminate your access to ARIS at any time, with or without cause, including for violation of these Terms. You may delete your account at any time by contacting us at support@alwaysberushing.com.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.

15. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which ABR Venture operates, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of ARIS shall be resolved through binding arbitration, except where prohibited by law. You waive any right to a jury trial or class action proceeding.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ABR Venture regarding your use of ARIS and supersede all prior agreements and understandings.
